Terms and Conditions

 

EVENT TERMS AND CONDITIONS


These Event Terms and Condition (“Event Terms”) apply to Cruise Seminars’:

(1)  seminars;

(2) face-to-face workshops;

(3) conferences; and

(4) any other Cruise Seminars events, courses or programs (including assessments),

(each an "Event"), unless the Event has its own specific terms, in which case those terms will apply to the extent of any inconsistency with these Event Terms.
 

These Event Terms govern Cruise Events Pty Ltd (ACN 617 210 456) trading as Cruise Seminars ("Cruise Seminars") and each person ("Attendee, You or Your") who has either:

(1) registered or enrolled to attend or participate in an Event; or

(2) been invited by Cruise Seminars to attend the Event.


In these Event Terms, the term “Registration” includes “Enrolment”, and “Register” (which includes “Enroll”) has a corresponding meaning.

Please read these Event Terms carefully as they contain important information. You acknowledge that You have read and agree to be bound by these Event Terms upon:

(1) submitting Your Registration to Cruise Seminars (whether hard copy, electronic or by telephone); or

(2) attending or participating in the Event if You are not required to Register for the Event.

 

1. Registrations
1.1 Event registrations are made in conjunction with a booking on the relevant cruise, facilitated with our cruise booking partners. Upon booking an event with Cruise Seminars, you are deemed to have read and agreed to these Booking Terms and Conditions (which constitute the entire agreement between you and us).


1.2 An invoice for the event will be issued to You from Cruise Seminars at the time you book the cruise with our cruise booking partner. The event fee (“Fee”) is due on the same date the final cruise fare is due. If the event fee is not paid in full on or before the due date, we will assume that You have cancelled Your Cruise Seminars event registration.


1.3 Your Registration is subject to acceptance by Cruise Seminars, which will be confirmed in writing (including but not limited to email) ("In Writing") after Cruise Seminars has received Your fully completed Registration, the Fee and any required supporting documents. Cruise Seminars may in its absolute discretion for any reason refuse to accept Your Registration.

 

2. Cancellation
2.1 Cancellation by You

 

2.1.1 Notification of cancellation of Your Registration for the Event may be made in writing and sent to Cruise Seminars by mail or email to the attention of Your local Cruise Seminars office (“Notification”).
 

2.1.2 If You cancel a Cruise Seminars event or are unable to board the ship on embarkation day for any reason, we will cancel Your registration and refund Your Fee paid to us.
 

2.1.3 Cancellation fees and/or penalties may also be imposed by the cruise line and/or our cruise booking partners (please refer to their terms and conditions). We recommend that You take out travel insurance when booking Your cruise and prior to Registration that will cover any cancellation costs incurred by You.


2.2 Cancellation by the cruise operator
 

2.2.1 If the cruise operator cancels the cruise in its entirety on or prior to embarkation day, we will cancel the event and refund Your Fees paid to us.
 

2.2.2 If the cruise operator cancels or shortens the period of the cruise after embarkation day, we will provide a refund of Your Fees equivalent to the portion of the Cruise Seminars event that was unable to take place because of the shortened time of the cruise.

 

3. Cruise Seminars’ rights
3.1 While Cruise Seminars endeavours to provide an Event on the basis on which it is advertised, Cruise Seminars reserves the right at any time to (“Cancellation or Amendment"):

(1) change the format, participants, content, location and timing or any other aspect of the Event; or

(2) cancel the Event or any part of the Event, and will not be liable for any damages, costs, losses or expenses of any kind incurred or suffered by You as a result of or in relation to Cruise Seminars modifying, postponing or cancelling the Event or any part of the Event.

 

3.2 In the event of any Cancellation or Amendment of an Event by Cruise Seminars:

(1) Cruise Seminars will on a best efforts basis make a full refund of the Fee to You (subject to any out of pocket expenses of costs of Cruise Seminars including any Credit Card Surcharge); and

(2) in no circumstances will Cruise Seminars be liable to You for Your out of pocket expenses arising from the Cancellation or Amendment including for any travel arrangements (including cruise fare, air fare, accommodation, meals, insurance and incidentals).

 

4. Your rights and obligations at the Event
4.1 Cruise Seminars reserves the right, without any liability, to refuse admission to, or to eject You from the Event, in its absolute discretion, including (without limitation), for failure to comply with these Event Terms or if in the opinion of Cruise Seminars You represent a security risk, nuisance or annoyance to the running of the Event.

 

4.2 You agree to comply with all reasonable instructions issued by Cruise Seminars or the operator of the venue for the Event.
 

4.3 All unauthorised photography and the recording or transmitting of audio or visual material, data or information is expressly prohibited at the Event and/or in or at the venue.
 

4.4 You consent to us using images of You taken during the Event and the cruise for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.

 

5. Limitations of liability and indemnity
5.1 Provisions of the Competition and Consumer Act 2010 and other laws in force from time to time in Australia may impose guarantees, warranties, conditions and obligations on Cruise Seminars ("Consumer Guarantees"). If any of these Event Terms are inconsistent with a Consumer Guarantee, the Consumer Guarantee will apply to the extent of such inconsistency. To the extent permitted by law Cruise Seminars’ liability and Your sole remedy will be limited to the refund of the Fee paid to Cruise Seminars. Subject to any applicable Consumer Guarantees, all guarantees, representations, conditions and warranties of any nature are expressly excluded.

 

5.2 Subject to any Consumer Guarantees and to the maximum extent permitted by applicable law, Cruise Seminars, its employees, agents and contractors will not be liable for personal injury or death, property damage, or any other loss (including without limitation, liability for negligence, breach of these Event Terms or any other agreement), damage, cost or expense (including, without limitation, loss of profits, business interruption, loss of information, indirect, special, punitive or consequential loss or damage) that You may incur or suffer arising out of or in connection with the Event.

 

5.3 You agree to fully indemnify and hold Cruise Seminars, its employees, agents, contractors and sub-contractors ("Representatives") harmless from any claim, cost, demand, liability or damage (including legal costs, professional costs and other expenses on a full indemnity basis) incurred by Cruise Seminars and/or its Representatives arising out of or in connection with the Event, including but not limited to:

(1) a breach of these Event Terms;

(2) Your use of the venue or attendance at the Event;

(3) any damage to the venue or any goods located at the venue; or

(4) the infringement of any intellectual property or other right of any third party (including the venue) by You.

 

6. General
6.1 Cruise Seminars reserves the right to amend these Event Terms from time to time and You will be subject to the terms in force at the time Cruise Seminars Registers You for the Event or You attend the Event, if you do not need to Register, whichever is applicable.

 

6.2 Any failure, delay or relaxation on the part of a party in exercising, in part or whole, any power, right or remedy conferred upon that party by these Event Terms shall not operate as a waiver of that power, right or remedy.
 

6.3 If any provision of these Event Terms is invalid or not enforceable by a court of competent jurisdiction, the relevant term is to be read down and shall otherwise be capable of being severed to the extent of the invalidity or unenforceability without affecting the remaining provisions of these Event Terms.
 

6.4 These Event Terms are governed by and are to be construed in accordance with the laws in force in New South Wales. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of New South Wales and waives any objection that it may have that proceedings have been brought in an inconvenient forum.

 

7. Privacy statement
Cruise Seminars is committed to protecting Your privacy and the confidentiality and the security of personal information provided by You. The personal information You provide is necessary to process Your Registration form which may include updating Your record and profile information. We may use Your personal information to contact You about our Services, to conduct analysis or market research to identify the ongoing needs of registrants, and to generally provide You with information on services and benefits. Personal information provided by You may be disclosed to external organisations that we engage for certain business functions such as our mailing houses, printers, technology service providers and marketing and communications agencies. Your personal information may be collected to enable You to access and use Cruise Seminars’ online platform. Your personal information may be transferred or stored outside the country where the information was collected for the purposes stated above.
