The existing ATO guidance and case law are vast and extensive and, at times, can be complex and confusing for practitioners and advisers. There are a huge number of tax implications that ensue out of winding up entities – whether a company or trust – and are often only considered at the time of actual winding up. This means it is frequently too late to facilitate a tax efficient exit and becomes an exercise in having to comply with the negative tax consequences that may occur. This session teases out the key income tax and capital gains tax implications that may arise on the winding up of companies and trust structures. Whilst most taxpayers regard the ATO as one large organisation, in reality this is not necessarily the way they see themselves. The ATO has been restructured in recent years and an understanding of the structure of the organisation can aid in helping to deal with and understand the ATO. The session also looks at who to speak to and who to avoid as well as developing an understanding of how many different parts of the ATO the average business may potentially have to interact with. Includes complimentary afternoon tea break and networking.

David has over 15 years’ experience within the accounting and tax industry in many jurisdictions within the Asia-Pacific region, the United Kingdom, and the European Union. Prior to establishing the Vendaval group – a group of companies focused on tax and business advisory as well as tax education – David was the youngest Head of Taxation at Tax & Super Australia (formerly Taxpayers Australia) in the organisations’ 100 year history. During his time at Tax & Super, he participated in many high-level government and tax advocacy forums, as well as appearing before parliamentary standing committees and in the media to discuss issues that impact taxpayers at all levels. He also oversaw the production of the 98th and 99th editions of “The Tax Summary”, an annual 2,000 page publication for tax professionals which digests and explains the tax legislation.
